Terms of Service

1. Agreement to Terms

By accessing or using BandSim ("the Game"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Game.

These Terms apply to all visitors, users, and others who access or use the Game. BandSim is operated by FastCloud Labs ("we," "us," or "our").

2. Account Registration

• You must be at least 13 years old to use BandSim
• You must provide accurate and complete registration information
• You are responsible for maintaining the security of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account
• One person may not maintain multiple accounts

3. Virtual Currency and In-App Purchases

Token System

• Tokens are virtual currency used within BandSim
• Tokens have no real-world monetary value and cannot be exchanged for cash
• Tokens cannot be transferred between accounts
• Unused tokens expire 12 months after purchase
• Token prices may change at any time without notice

Purchases

• All purchases are final and non-refundable except as required by law
• Purchases are processed through platform payment systems (Apple App Store, Google Play)
• You agree to the payment terms of the platform provider
• We are not responsible for any payment issues between you and the platform provider

Refund Policy

Refunds for token purchases must be requested through the platform where you made the purchase (Apple App Store or Google Play Store) according to their refund policies.

4. User Content and Conduct

Content Ownership

• You retain ownership of original content you create in BandSim
• You grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and distribute your content within the Game
• For competition winners, you grant additional rights for music distribution to streaming platforms
• You represent that you have all necessary rights to the content you submit

Prohibited Conduct

You agree not to:

• Use the Game for any unlawful purpose
• Harass, abuse, or harm other users
• Create or share inappropriate, offensive, or harmful content
• Attempt to hack, modify, or reverse engineer the Game
• Use bots, automation, or other cheating methods
• Impersonate others or create false identities
• Violate any third-party intellectual property rights
• Engage in any activity that disrupts the Game or servers

5. Competitions and Prizes

Competition Rules

• Competitions are skill-based challenges, not games of chance
• Entry requires token payment (10-20 tokens typically)
• Alternative free entry methods may be available as required by law
• Winners are selected based on community voting and/or judge decisions
• Competition rules may vary and will be specified for each competition

Prize Distribution

• Prizes are awarded as specified in competition rules
• Prize winners may be required to provide tax information
• Winners are responsible for all taxes on prizes
• Prizes cannot be transferred or exchanged for cash equivalents
• We reserve the right to substitute prizes of equal value

Music Distribution Rights

By winning a competition that includes music distribution, you grant us the necessary rights to distribute your music on streaming platforms (Spotify, Amazon Music, etc.) and collect royalties on your behalf, which will be distributed according to the competition terms.

6. Intellectual Property

BandSim Property

The Game, including all content, features, and functionality, is owned by FastCloud Labs and is protected by international copyright, trademark, and other intellectual property laws.

User License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Game for personal, non-commercial purposes in accordance with these Terms.

Copyright Infringement

We respect intellectual property rights. If you believe content in the Game infringes your copyright, please contact us at info@bandsim.com with:

• Description of the copyrighted work
• Location of the infringing content
• Your contact information
• Statement of good faith belief
• Statement of accuracy under penalty of perjury

7. Disclaimers and Limitations of Liability

No Warranties

THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE GAME WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE GAME.

Indemnification

You agree to indemnify and hold harmless FastCloud Labs and its affiliates from any claims, damages, or expenses arising from your violation of these Terms or your use of the Game.

8. Account Termination

• We may terminate or suspend your account at any time for violation of these Terms
• You may delete your account at any time through the Game settings
• Upon termination, you lose access to your account and any virtual items or currency
• Provisions that should survive termination will remain in effect

9. Dispute Resolution

Arbitration Agreement

Any disputes arising from these Terms or your use of the Game shall be resolved through binding arbitration, except where prohibited by law. You waive your right to participate in class actions.

Governing Law
